On October 4, 1985, Joe C. Mozeke, an employee of Brown & Root (“B & R”), was struck by a falling object while working inside of a pine digester owned and operated by International Paper Company (“IP”) at its plant located in Mansfield, Louisiana (the “Mansfield Mill”). Mozeke and his wife sued IP and the manufacturer of the pine digester, Kamyr, Inc. (“Kamyr”), seeking to recover for the injuries they sustained as a result of this accident.
