*18Proceeding to review an award of the Industrial Commission in favor of the widow and minor children of one Rasmus H. Nielson, who lost his life as the result of an accident happening near Duchesne, Utah, on the 4th day of August, 1921. Deceased died at 3 p. m. on the day following the accident.

The principal contentions of plaintiff, the Continental Casualty Company, for annulling the award, may be stated: (a) That no policy of insurance was in existence at the date of the accident; (b) that the deceased was not an employé of the insured at the time.
