This is an action in replevin instituted by the plaintiff in error against Harry Abels, the defendant in error, to recover possession of personal property of the value of $1,060. The cause was tried to the court, which rendered judgment in favor of the defendant on his answer and cross-petition. The facts, as stipulated, are as follows:
