Introduction

Defendant has moved and plaintiff has cross-moved for summary judgment pursuant to USCIT Rule 56. These cross-motions raise the issue of the proper tariff classification for certain headwear, alleged by plaintiff to be disposable nurses’ caps, imported into the United States through the port of El Paso, Texas between July 1972 and July 1979.
