Plaintiff, Roy Kinn, and defendant, Prairie Farms/Muller Pinehurst, agreed to settle plaintiffs workers’ compensation claim. After plaintiff discovered that a medical bill remained unpaid, he sued defendant in the circuit court of Winnebago County to rescind the settlement agreement. Plaintiffs amended complaint alleged unilateral mistake, mutual mistake, and fraud. The trial court dismissed the complaint, holding that it lacked jurisdiction to consider the first two claims and that plaintiff had not adequately pleaded the third.
