GARRITY, Judge.
The appellant, Paul Alexander Russell, who had been charged in a three-count indictment, was convicted on July 25, 1985, by a jury in the Circuit Court for Montgomery County (Latham, J. presiding) of possession of controlled dangerous substances and of possession of controlled paraphernalia. The jury was unable to reach a verdict as to the charge of possession with intent to distribute a controlled dangerous substance (marijuana).
