Jean Y. Denis (“Plaintiff’) brings this diversity action against the Town of Haverstraw and Police Officer McManus (“Officer McManus”) in his official capacity (collectively, “Defendants”). Plaintiff alleges that he was injured by the negligence of Officer McManus in directing Plaintiffs car across a railroad crossing at the intersection of Short Clove Road and Route 9W in the Town of Haverstraw, New York, and that as a result, Plaintiffs car was hit by an oncoming CSX train.
