This suit was instituted by defendant in error against plaintiff in error in the justice court, precinct No. 3, of Montgomery county, Tex., to recover $136 as the value of two cows alleged to have been negligently killed by plaintiff in error, and for $20 as ¿ttorney’s fees.

Judgment in the justice court was for defendant in error for the amount sued for. The case was appealed to the county court of Montgomery county.
