Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of the Coihptroller which denied petitioner’s application for accidental disability retirement benefits.

In 1994, petitioner, a police captain for the City of Yonkers in Westchester County, fell on icy stairs at the city jail, alleging injuries to his head and right leg.
