Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Comptroller which denied petitioner’s application for accidental disability retirement benefits.

Petitioner, a police officer with the Suffolk County Police Department, was riding a motorcycle on September 18, 2001 as part of a funeral procession for a firefighter who had been killed in the September 11, 2001 terrorist attacks on the World Trade Center in New York City.
