Proceeding pursuant *793to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for accidental disability retirement benefits.

At all times relevant to this proceeding, petitioner Steven D. Spencer (hereinafter petitioner) was employed as a Deputy Sheriff and head canine officer for the Chemung County Sheriffs Department.
