The petition in this case alleges that the plaintiff and defendant entered into a written contract on March 31, 1925, for the construction of a portion of a public highway in Uinta County, Wyoming, known as Federal Aid Project No. 173 A, namely, between stations 1245 and 1341 thereof, the plaintiff to be paid upon the basis of unit prices for the work to be done; that this written contract was made as a subcontract under a written main contract between tne defendant and the State of Wyoming; that plaintiff commenced work on April 6, 1925, and performed a certain portion…
