MEMORANDUM OPINION

Defendants have applied for a stay 1 of the Court's order of October 16, 1996, granting plaintiff's request for a permanent injunction. Since defendants have failed to establish that the factual findings made at the hearing were incorrect, or that the defendants will suffer irreparable harm from the injunction, the Court finds that a stay pending appeal is not warranted. Additionally, a review of the existing case law convinces the Court that the order granting injunctive relief is not an appealable order, which makes it very likely that the appeal will not succeed on the…
