{¶ 1} The Estate of plaintiff-appellant Robert Rahmes ("Estate") appeals from summary judgment granted in favor of defendants-appellees Oglebay Norton Company, Owens-Illinois, Inc., McGraw Construction Company, Inc. And R.E. Kramig Company, Inc. ("Kramig"). Subsequently, the following defendants-appellees settled all claims with the Estate: Oglebay Norton Company, Owens-Illinois, Inc., and McGraw Construction Company.
