WARRINGTON, Circuit Judge.
This is an appeal from an order of the District Court temporarily enjoining appellant (defendant below) from infringing United States letters patent No. 644,077. The patent was granted February 27, 1900, to appellee (complainant below) as assignee of Felix Hoffman, for an improvement made by him in acetyl salicylic acid, known in pharmacy as “aspirin.” The bill is in ordinary- form, except that it contains averments that in a suit in equity for infringement of such letters patent, brought by the present appellee against Edward A.
