Appeal from a judgment of the Supreme Court (Lamont, J.), rendered January 9, 2004 in Albany County, upon a verdict convicting defendant of the crimes of burglary in the first degree, rape in the first degree, assault in the second degree and unlawful imprisonment in the first degree.
