Intrepid Potash-New Mexico, LLC brings claims under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq., against the United States Department of Interior (“DOI”), the DOI Secretary in his official capacity, 1 and the United States Bureau of Land Management (“BLM”), asserting that the decision by the Interior Board of Land Appeals (“IBLA”) to approve permits to drill oil and gas wells on protected federal land violates federal law.
