THIS CAUSE is before the Court upon Defendant’s Motion to Dismiss Complaint, filed on April 3, 2009. (D.E. 15.) Plaintiff filed his Response in opposition on April 20, 2009. (D.E. 17.) Defendant filed its Reply in further support of its Motion on April 30, 2009. (D.E. 18.) Also before the Court is Plaintiffs Unopposed Motion for Hearing, filed on May 1, 2009. (D.E. 19.)
