This case is before the court on crossmotions for summary judgment. Plaintiff, The Faulkner Hospital Corporation (“Faulkner”), owns and operates a nonprofit general community hospital in Jamaica Plain, a section of Boston, Massachusetts, and is an approved provider of hospital services under Title XVIII of the Social Security Act, 42 U.S.C.A. § 1395 et seq.
