On March 21, 1939, G. C. Van Horn, defendant in error herein, brought action in the district court of Payne county against Malda Van Horn, plaintiff in error herein, for a decree of divorce and partial custody of their child. The parties will hereafter be referred to as plaintiff and defendant, respectively, as they appeared in the trial court.
In his petition, plaintiff alleged that he has no desire to take the custody of the child away from the mother and wishes to contribute a reasonable amount to said child’s support; then further alleged that his wife had abandoned him, that…
