Plaintiffs, husband and wife, seek to nullify a statutory mortgage foreclosure. The fore closed mortgage, given by plaintiffs in 1924, was for a loan of $2,500 and covered real property owned by plaintiffs in tbe city of Battle Creek. Tbe mortgagee, tbe Old-Mercbants National Bank, recorded tbe mortgage. Tbe Old-Mercbants National Bank & Trust Company, as successor to tbe mortgagee, on June 9, 1934, assigned tbe mortgage to tbe Reconstruction Finance Corporation as security for money loaned.
