I. BACKGROUND

Plaintiffs Allen-Bradley Company, L.L.C. and Reliance Motion Control, Inc. (“Alen*317Bradley”) commenced this action when, on June 1, 1999, they filed a complaint seeking a declaratory judgment of non-infringement of certain patents owned by defendant Kollmorgen Corporation (“Kollmorgen”). Kollmorgen filed an answer and asserted counterclaims against Allen-Bradley, alleging infringement of some of the patents.
