This case has resulted from a traffic accident that occurred in the city of Battle Creek about 7:30 o’clock in the evening of January 10, 1953. While crossing a public street in that city, plaintiff’s decedent, Claude Ray Goddard, a child 3 years of age, was struck by an automobile driven by defendant, sustaining injuries resulting in death the following day. The present suit was started by the administratrix of the estate of said child under date of July 20, 1955.
