This is a case tried before the Honorable W. W. Lessley, District Judge of the eighteenth judicial district, in and for the County of Gallatin, tried without any jury and submitted to the district judge on an agreed statement of facts. From *460the finding for the defendant Commission the appellant brings this appeal.
