ORDER
JORGENSON, District Judge.
Pending before the Court is Defendant’s Motion for Summary Judgment. For the reasons stated below, the motion is denied.
I. Standard of Review
Summary judgment is appropriate where “there is no genuine issue as to any material fact.” Fed.R.Civ.P. 56(c). A genuine issue exists if “the evidence is such that a reasonable jury could return a verdict for the nonmoving party,” and material facts are those “that might affect the outcome of the suit under the governing law.” Anderson v.
