Plaintiffs originally sued defendants for equitable relief and for general and punitive damages, alleging that defendants conspired to defraud plaintiffs. Defendants filed a motion for summary judgment, which the lower court denied, and on appeal to the Supreme Court of Georgia a reversal was entered, said court holding that there was no evidence of a conspiracy between the defendants, and therefore, there was no issue presented as to the existence or nonexistence of a conspiracy.
