The plaintiff brought this action to recover damages for trespass. He furthermore sought an injunction ordering the defendant to remove a wire fence and to desist from using a portion of a concrete stairway standing upon land claimed to be owned by the plaintiff. The defendant, in his answer, denied that the plaintiff was the owner and in possession of the strip of land in question and, in a special defense, alleged title to the strip by adverse possession.
