This matter comes before the Court upon Defendants' Motion to Dismiss the Second Amended Complaint (Doc. 43), and Plaintiff's response thereto (Doc. 46). Plaintiffs filed a five-count Second Amended Complaint (Doc. 41) against Defendants seeking payment of overtime wages under the Fair Labor Standards Act, 29 U.S.C. §§ 201 - 219 ("FLSA"), damages for filing a fraudulent information return, recovery of unpaid wages under Florida law, and unlawful retaliation in violation of the FLSA.
