SINGLETON, Chief Judge.
This action arises under the Veteran’s Reemployment Rights Act (“The Act”), 38 U.S.C. §§ 2021-2026 (1979 & Supp.1983). Plaintiff Billy W. Akers sues defendants as trustees of the Maritime Association — International Longshoreman’s Association (“I.L.A.”) Pension Fund for pension benefits which he alleges were denied him in violation of the Act.
