Tlie complaint in three counts alleged that deceased was wrongfully killed by an employee of defendant. In the first count the wrongful act was ascribed to W. B. Ratteree; in the second count it is alleged that'plaintiff’s intestate was wrongfully and- intentionally shot by an unknown employee of defendant; and the third count, as amended, charged that deceased was wrongfully assaulted and beaten by C. W. Hood, an employee of defendant, and as a proximate result thereof plaintiff’s intestate died.
