The relator was convicted in Queens County, New York, after a jury trial, of' burglary third degree, robbery first de— *471■gree and assault second degree, and on May 2, 1952 was sentenced by Queens •County Judge Farrell as a fourth felony offender to a term of from thirty years to life. He was resentenced on April 28, 1958 as a third offender to a term of not less than twenty nor more than sixty .years after a 1926 conviction used against him previously was vacated.
