MEMORANDUM OPINION

WILLIAM L. STOCKS, Bankruptcy Judge.

This adversary proceeding was brought by the plaintiffs, who are the Chapter 7 trustee for the debtors and NationsBank of North Carolina, one of the principal creditors of the debtors. The purpose of this proceeding is to “invalidate, avoid, and cancel” a deed of trust which was executed by the debtors on November 18, 1991. The deed of trust was executed to secure a promissory note from the debtors to the defendant, Tommy Thomas. The amount of the promissory note to Mr. Thomas is $107,500.00 and, like the deed of trust, the note is dated…
