Defendant-appellant, Stephen Werneth, appeals from a jury verdict finding him guilty of embezzlement by corporate officer under I.C. § 18-2402. 1 Werneth claims that the jury trial violated his constitutional right not to be twice placed in jeopardy.

In April, 1976, Werneth was placed on trial for the crime of embezzlement by bailee under I.C. § 18-2407. 2 That charge was based on an allegation that Werneth fraudulently converted to his own use approximately eighteen tons of wheat which had been entrusted to him during the 1974 harvest season.
