This cause was transferred to this court after judgment affirmed by the district court of appeal.

On December 30, 1909, William A. Butler, brother of the plaintiff, entered into a written contract with the defendant Gas Company to furnish the labor and material and do the brick and terra-cotta work on a certain building to be constructed for the defendant, the latter agreeing to pay him therefor the sum of two thousand nine hundred and forty dollars.
