PETTINE, Chief Judge.

This is an action for declaratory judgment filed on August 10, 1977 by Ciba-Geigy Corp., with Ansul Co. and Able Fire and Safety Equipment, Inc. as coplaintiffs, against Minnesota Mining and Manufacturing Co. (3M). Plaintiffs seek a declaration that their making, using and selling a certain fire-fighting foam, Ansul AFFF, 1 and its component ingredients do not infringe patents owned by defendant, because said patents are invalid, void and unenforceable.
