The applicant moves by petition why:

1. This court should not determine that petitioner Raymond J. Funkhouser received the highest number of votes cast and was the successful candidate for the office of supervisor of the town of Harrison at the general election held on November 5, 1935.

2. The Westchester county board of canvassers should not be directed and required to so canvass the votes cast for such office and make its statement of canvass accordingly, and the said board and the Westchester county board of elections should not be directed and required to issue a certificate of election to…
