Defendants are charged with one count of grand larceny in the second degree under section 155.40 (1) of Penal Law and 13 counts of offering a false instrument for filing under section 175.35 of Penal Law, in connection with an alleged scheme related to Medicaid claims.1 In the instant application defendants move for an order: (1) finding that the special assistant attorney general assigned to the trial of this case violated Code of Professional Responsibility DR 7-104 (a) (1) (22 NYCRR 1200.35 [a] [1]) and, as a sanction for the trial assistant’s…
