SMITH, Judge.

Max L. Starr petitions for review of the order of the Environmental Hearing Board (Board) which sustained the order of the Department of Environmental Resources (DER) filed pursuant to the Solid Waste Management Act (Act) 1 and Section 1917-A of The Administrative Code of 1929. 2 DER’s order charged, inter alia, that Starr was operating a waste storage and disposal facility without a permit in violation of the Act in that tires collected by Starr from various commercial tire dealers were stored on Starr’s property in a manner which resulted in the creation of a public nuisance…
