This is an action in ejectment to recover two lots of land situated in the town of North Hempstead, Nassau county. Trial by jury was waived, and the case was submitted to the court upon an agreed statement of facts and testimony taken on the trial. The facts set forth in such statement, briefly recited, are as follows: On or about December 17, 1912, Charles L. Sicardi and Henry F. Koch and their wives quitclaimed the premises in question, with other property, to one Bessie F. Goetschius, for an “ alleged ” consideration of ten dollars, by deed recorded February 8, 1913.
