LaBrier’s house was damaged in a hail storm, a covered loss under her insurance policy issued by Defendant State Farm Fire and Casualty Company. LaBrier made a claim under the section of the policy that provided for an “actual cash value” (ACV) payment to be made to an insured before, and regardless of whether, the insured repaired or replaced the damaged property.
