Appeal from a judgment of the Supreme Court (Lamont, J.), rendered December 8, 2000 in Albany County, convicting defendant following a nonjury trial of the crime of rape in the first degree.
Defendant was indicted by a grand jury for the crimes of *878rape in the first degree and burglary in the second degree stemming from an incident which occurred in the early morning hours of November 21, 1999.
