Appeal from a judgment of the County Court of Rensselaer County (Breslin, J.), rendered August 25, 2005, upon a verdict convicting defendant of the crime of rape in the first degree.

Following a jury trial, defendant was convicted of rape in the first degree by engaging in sexual intercourse with a victim incapable of consent by reason of being physically helpless.
