Fin-Clair Corporation (“Employer”) appeals from an order of the Missouri Labor and Industrial Relations Commission (“the Commission”), deciding that Aubrey Tut-wiler (“Claimant”) was eligible for waiting week credit and unemployment benefits because his discharge was not for misconduct connected with work within the meaning of Section 288.050.2 RSMo. (1994). We affirm.

Claimant is a former employee of Employer. Employer fired Claimant for excessive absenteeism pursuant to a compa ny rule prohibiting more than three unexcused absences within a six-month period.…
