— This suit was instituted by appellee to enjoin appellants from selling the land described in appellee’s petition. It was alleged, in substance, that said tract of land, containing about' eight acres, and situated in Dallas County, Texas, constituted the homestead of appellee and his family; that appellant Walker, as trustee, had advertised said land and homestead for sale May 3, 1904, under and by virtue of the terms of a deed of trust given by appellee and his wife on the 19th day of January, 1903, to séeure the payment of three promissory notes in the sum of…
