ARMIJO, Judge.

{1} The opinion filed on November 22, 2000 is withdrawn and the following is substituted in its place. The motion for rehearing is otherwise denied.

{2} Carlsbad Municipal Schools (District) appeals from a judgment in favor of Pablo Franco (Franco) awarding him damages of $49,548 plus interest in his suit for wrongful termination of employment.
