The complaint charged the defendant James M. Owens by act, or by word, encouraged and contributed toward, caused or tended to cause a child under the age of 17, Diane Koskela, to become neglected or delinquent so as to come, or tend to come, under the jurisdiction of the juvenile division of the probate court in that the defendant “did then and there harbor the said Diane Koskela while she was missing from home” in violation of CL 1948, § 750.145 (Stat Ann 1962 Rev §28.340). (Emphasis supplied.) The case was tried without a jury. The judge found the defendant guilty, stating:
