FISHER, Chief Justice.

This action is by J. E. Foster and Cora B. Foster against J. W. Turney, Hat Burns, William Burns, and J. H. Eoff, as stated in their amended petition, filed January 3, 1898, wherein they sue in ordinary action of trespass to try title to recover from defendants the land in controversy, and ih a further count state that in the event they-are not entitled to recover the land, then they pray for a foreclosure of a vendor’s lien.
