Appellee, A. O. Miller, sued appellant, Galveston, Harrisburg & San Antonio Railway Company, to recover damages for personal injuries alleged to have been suffered by plaintiff while a passenger upon one of appellant’s trains. Tlie case was submitted in a general charge to a jury, which returned a verdict in favor of appellee for $17,750, upon which judgment was rendered.

Appellee alleged that the train on which he was a passenger was derailed and wrecked through the negligence and carelessness of the appellant, its servants and employés, and the car, on which appellee was a passenger, was…
