ALLRED, District Judge.

Appellant was convicted by a jury on three counts of an indictment charging violation of, and conspiracy to violate, the Marihuana Tax Act, 26 U.S.C.A. §§ 2590, 2591(a) and 2593(a). The conspiracy count charged that appellant conspired with Royster, a co-defendant, who also was convicted on two other substantive counts. The evidence against appellant was weak and circumstantial, dependent almost entirely on the testimony of C. B.
