Donald G. Austin appeals from his conviction on one count of second degree assault and one count of possession of a controlled substance. Two issues are presented for review: (1) did the trial court improperly interpret the law on assault by ruling that the State need not prove intent to cause the victim reasonable apprehension and fear of injury, and (2) should the charges have been dismissed on speedy trial grounds.
